What are Expert Witness Boundary Reports?
An Expert Witness Boundary Report is used when a boundary matter has moved beyond general advice and requires independent technical opinion for mediation, arbitration or court proceedings.
In this role the surveyor is not acting as an advocate for the client. The surveyor’s duty is to the court, and the report must be objective, reasoned and based on verifiable material.
The work usually begins with the same foundation as any strong boundary case: accurate site measurement and careful document review. The difference is in the standard of reporting.
A Part 35 report must set out the expert’s instructions, the material relied upon, the facts observed, the reasoning applied, any limits in the evidence and the conclusions reached. It must also include the required statement of truth and clear acknowledgement of the expert’s duty to the court.
For solicitors, this service is valuable where the boundary issue is technical, the other side has obtained its own survey evidence, or the court needs a specialist to explain why a particular boundary interpretation is more persuasive than another.
